Terms & Conditions

1. Agreement

By creating an account, downloading the desktop app, or otherwise using DigGems (the "Service"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. If you use the Service on behalf of an organization, you confirm you are authorized to bind it to these Terms.

3. The Service

DigGems provides tools to extract, validate, generate, sort, and country-target email addresses from public sources or user-supplied inputs. The Service is offered on a pay-as-you-go basis using USDT on the Tron network (TRC-20). We may add, modify, or remove features at any time.

4. Accounts

You are responsible for your account credentials and for all activity under your account. Notify us immediately at support@diggems.dev if you suspect unauthorized access.

5. Credits, billing & refunds

  • $1 USDT buys 20,000 harvested emails or 30,000 sorted emails.
  • Credits are added automatically on on-chain confirmation of a TRC-20 deposit to your unique wallet address.
  • Credits do not expire but are non-transferable and non-withdrawable.
  • Because USDT payments are irreversible, purchased credits are non-refundable. We will, however, refund credits automatically when the Service fails to deliver (e.g. a real-time country pool shortfall).
  • You are responsible for any taxes applicable to your use of the Service.

6. Acceptable use

You agree not to use the Service to:

  • Send unsolicited bulk email or otherwise violate CAN-SPAM, GDPR, CASL, or any other applicable anti-spam or privacy law;
  • Harvest data from sources that explicitly prohibit automated access, or that you are not lawfully authorized to access;
  • Attempt to reverse-engineer, resell, or sublicense the Service;
  • Interfere with the Service, its security, or other users;
  • Use the Service for phishing, fraud, harassment, malware distribution, or any unlawful activity.

We may suspend or terminate accounts that violate these rules and cooperate with law-enforcement requests as required.

7. Your content & data

You retain ownership of the inputs you submit and the outputs you generate. You grant us a limited license to process them solely to operate and improve the Service. You are solely responsible for the legality of your inputs and how you use the outputs.

8. Third-party services

The Service depends on third-party infrastructure (cloud hosting, email delivery, blockchain networks). We are not responsible for outages, delays, or losses caused by these third parties.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that harvested emails belong to willing recipients or that any given address is deliverable.

10. Limitation of liability

To the fullest extent permitted by law, DigGems will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the 3 months preceding the claim.

11. Indemnity

You agree to indemnify and hold DigGems harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your inputs, your outputs, your messaging campaigns, or your breach of these Terms or applicable law.

12. Termination

You may close your account at any time by contacting support. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Sections that by their nature should survive termination will do so.

13. Changes

We may update these Terms. Material changes will be announced by email or in-app notice at least 14 days in advance. Continued use of the Service after a change means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws applicable to the operator of DigGems, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, unless mandatory consumer-protection law entitles you to a different forum.
